The justice and penal system is how we decide who does more evil things. And common sense, when the answer is obvious. For example, Hitler did much more evil than, say, a shoplifter.

:3 I'm sure she doesn't. Especially since we can almost never know every factor when we have to decide a case, unless we were there. And even then, it depends on whose point of view it is, and who's in charge.
